GREEN BAY, WI (WTAQ-WLUK) – Ji-Gwe-Mko Layton admitted to shooting a man while traveling on Highway 172 because he was afraid the driver was going to rob his home while Layton was at work, according to charges filed Tuesday.
In court Tuesday, Layton’s defense attorney requested a competency exam.
Competency refers to the defendant’s ability to understand the court proceedings and assist in his own defense.
He returns to court Sept. 5, where a judge will order a psychiatric exam. The court commissioner who presided over Tuesday’s hearing doesn’t have the authority to order the review.
A cash bond of $750,000 was set at a previous hearing.
According to the criminal complaint, police responded to the ramp from State 172 westbound to Interstate 41 southbound for a crash at 12:30 p.m. on Aug. 15. A vehicle had gone into a ditch, and a male had fled the crash scene. An officer spotted Layton, and ordered him to the ground.
“Sergeant Pizzala reports that he asked Layton what happened. Layton stated, ‘okay so [Victim 1] was acting like he was going to rob my safe while I was at work.’ Sergeant Pizzala asked Layton, ‘did you kill somebody?’ Layton stated “[Victim 1],” the complaint states.
Authorities have not identified the victim, nor his relationship to Layton. The victim died of “multiple gun shot wounds,” the complaint states.
Police searched Layton’s residence in Wood County, where two safes were found.
The ramp was closed for several hours on Aug. 15 as police investigated the scene.
