APPLETON, WI (WTAQ-WLUK) – A tentative trial date of Dec. 13 was set Monday for Dezman Ellis, who allegedly shot & killed a man at Fox River Mall.
Ellis, 17, is charged with first-degree intentional homicide for allegedly killing Jovanni Frausto Jan. 31 during a dispute about a girlfriend. Ellis is also charged for allegedly shooting a bystander, as well.
The trial date could be postponed, depending on if prosecutors need to handle a different murder trial scheduled for Nov. 29. Outagamie County District Attorney Melinda Tempelis said there’s not enough time to prepare for the Ellis trial if the other trial happens.
Ellis’ previous attorney had filed a motion to move to the trial out of Outagamie County due to pre-trial publicity, but his current attorney asked that matter be put on hold, at least for now.
In Wisconsin, 17-year-olds are considered adults for the purpose of criminal court.
