APPLETON, WI (WTAQ-WLUK) – A plea deal is expected to resolve the case of an underage suspect in a fatal traffic crash who allegedly had a blood alcohol level more than double the legal limit and was driving more than 130 mph, his attorney said Thursday.
Carter Green, 19, is charged with first-degree reckless homicide and two misdemeanors for the Oct. 4 crash in Appleton that killed one person and injured two others.
During a hearing Thursday, attorney Walter Piel said a plea offer from the state will be accepted. An Oct. 12 hearing was set for that.
According to the criminal complaint, emergency crews responded to a crash near Richmond Street and Interstate 41 at about 1:30 a.m. One person was taken to the hospital, and later was pronounced dead. The victim’s name has not been released.
When interviewed by police, Green said he had a green light when he entered the intersection, and said he had not been drinking.
However, a passenger in Green’s car said Green had four beers at bonfire earlier in the evening, and then a non-alcoholic beer at a strip club before the crash.
The passenger said he saw the speedometer reach 130 mph after they left the bonfire, and that Green ignored his requests to slow down.
“Carter had just gotten a new turbo put in that car that day,” the passenger said.
Green failed elements of a field sobriety test, and a preliminary breath test registered a .178 BAC, more than twice the legal limit, the complaint states.
A review of traffic cameras and surveillance video resulted in speed estimates of 130 to 143 mph, and the images indicated Green would have had a red light at the time of the crash, according to the complaint.
