APPLETON, WI (WTAQ-WLUK) — The case of a boy originally charged in adult court with attempted homicide for a Grand Chute shooting has been moved to juvenile court.
The teen — who was 13 at the time of the incident, but is now 14 — faces counts of attempted first-degree intentional homicide and attempted armed robbery for the Aug. 25 incident.
In Wisconsin, those ages 10 and older charged with homicide-related counts start in adult court, but there is a mechanism, as used in this case, for the defense to request to have the case moved to juvenile court under certain circumstances. Once there, suspects are not to be identified publicly, per state law.
In court Tuesday, Outagamie County Judge Gregory Gill ordered the boy to continue to be held in secure detention — the juvenile version of jail — as the case proceeds. The teen is currently in custody in Portage County.
No future court dates have been scheduled
Also charged in the case are Dequan Pearson, 17, and Jayshawn Jones, 18.
According to the criminal complaints, the 13-year-old and Pearson met for a drug deal on Timmers Lane. Each blamed the other for initiating a robbery and for shooting first, but both admitted to firing shots at the scene.
Pearson is scheduled to stand trial May 11 on 11 counts, including two of attempted homicide.
Jones is scheduled to stand trial Feb. 1 on an attempted armed robbery charge.
