MADISON, WI (WTAQ) - A state appeals court today upheld the conviction of a southern Wisconsin man for killing a young mother 33 years ago.

Curtis Forbes of Randolph said his jury should never have heard that his wife saw blood on his shirt.

But the Fourth District Appellate in Madison said that if the judge erred in that regard, there was still enough other evidence to find Forbes guilty.

He was convicted in 2010 of beating, stabbing, and strangling 18-year-old Marilyn McIntyre at her apartment in Columbus in 1980. Her body was exhumed in 2008. It uncovered new evidence, and Forbes was arrested in 2009 after blood was found from both the killer and his victim in McIntyre’s apartment.

Forbes also contended that his jury should have been allowed to hear more evidence which implicated McIntyre’s husband.

But the appellate court didn’t buy that, either.

Forbes, who’s now 55, was sentenced to life in prison – but a judge set a possible date of 2020 to consider a supervised release.
